{"id":21542,"date":"2019-10-16T09:55:20","date_gmt":"2019-10-16T07:55:20","guid":{"rendered":"https:\/\/www.serhsserveis.com\/?p=21542"},"modified":"2023-04-26T19:52:39","modified_gmt":"2023-04-26T17:52:39","slug":"circular-informativa-departamento-juridico-serhs-serveis","status":"publish","type":"post","link":"https:\/\/serhsserveis.com\/es\/circular-informativa-departamento-juridico-serhs-serveis\/","title":{"rendered":"Circular informativa departamento jur\u00eddico SERHS Serveis"},"content":{"rendered":"<h3 class=\"o_mail_no_margin\">Desde el departamento jur\u00eddico<a href=\"https:\/\/serhsserveis.com\/es\/asesoria-laboral-y-fiscal-soluciones-eficientes-para-tu\">\u00a0de SERHS Serveis<\/a> te informamos de los derechos de trabajador y empresario, en cualquier convocatoria de huelga.<\/h3>\n<p><span style=\"font-weight: 400;\">Los sindicatos Intersindical-CSC e Intersindical Alternativa de Catalunya han convocado una huelga\u00a0 general en Catalu\u00f1a para el pr\u00f3ximo d\u00eda 18.10.2019.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Los sindicatos m\u00e1s representativos (CCOO i UGT) no se han adherido formalmente a la convocatoria de huelga.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mediante la presente circular os recordamos los principales aspectos a tener en consideraci\u00f3n relacionados con la huelga en lo que se refiere a derechos y obligaciones; tanto del empresario como del trabajador.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00a0\u00a0\u00a0\u00a0\u00a0<\/span> <span style=\"font-weight: 400;\">Las principales consecuencias del ejercicio del derecho a la huelga son los siguientes:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">No extingue el contrato laboral, s\u00f3lo se limita a <\/span><b>suspenderlo <\/b><span style=\"font-weight: 400;\">durante la duraci\u00f3n de la huelga.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><b>Exonera<\/b><span style=\"font-weight: 400;\"> al trabajador de su obligaci\u00f3n de <\/span><b>trabajar<\/b><span style=\"font-weight: 400;\"> y al empresario de su obligaci\u00f3n de <\/span><b>abonar el salario<\/b><span style=\"font-weight: 400;\"> correspondiente al d\u00eda concreto de la convocatoria.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">El descuento que se ha de aplicar sobre la retribuci\u00f3n del trabajador que hace servir el derecho a huelga repercutir\u00e1 sobre su salario base + complementos salariales. (salario d\u00eda) y sobre la parte proporcional de las pagas extras. Pero no afecta a d\u00edas de vacaciones.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">El derecho a huelga es individual y <\/span><b>voluntario<\/b><span style=\"font-weight: 400;\">. Por tanto, la empresa ha de respetar la voluntad tanto del trabajador que se suma a\u00a0 la convocatoria como el que decide ir a trabajar. No se puede cerrar el centro de trabajo ni sancionar al trabajador que no asista a trabajar.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Ahora bien,, si la empresa opta por el cierre del centro de trabajo porque quiere adherirse a la protesta, o por cualquier otro motivo, no podr\u00e1 aplicar ning\u00fan tipo de descuento salarial ni repercusi\u00f3n a nivel de seguridad social.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Mientras dura la huelga no existe la obligaci\u00f3n de cotizar por parte del empresario ni del trabajador. Por tanto, el trabajador es dado de baja durante el periodo de duraci\u00f3n de la huelga. Una vez acabada la huelga se vuelve a la situaci\u00f3n\u00a0 ordinaria de alta.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Existe la prohibici\u00f3n expresa de contratar trabajadores para sustituir a los trabajadores huelguistas,\u00a0 aunque sea a trav\u00e9s de ETT.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">El trabajador no est\u00e1 obligado a avisar de que se acoge al derecho de huelga.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: center;\"><em><span style=\"font-weight: 400;\">Es <\/span><b>importante<\/b><span style=\"font-weight: 400;\"> que se comunique al departamento de Administraci\u00f3n de personal, como m\u00e1ximo el d\u00eda <\/span><b>21.10.19<\/b><span style=\"font-weight: 400;\">, la relaci\u00f3n de trabajadores que ha dispuesto de este derecho para que se pueda comunicar a la Tesorer\u00eda General de la Seguridad Social en plazo el movimiento de baja y alta posterior<\/span><span style=\"font-weight: 400;\">.<\/span><\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Desde el departamento jur\u00eddico\u00a0de SERHS Serveis te informamos de los derechos de trabajador y empresario, en cualquier convocatoria de huelga.
