{"id":23261,"date":"2020-02-25T13:11:36","date_gmt":"2020-02-25T12:11:36","guid":{"rendered":"https:\/\/www.serhsserveis.com\/?p=23261"},"modified":"2023-04-26T19:52:31","modified_gmt":"2023-04-26T17:52:31","slug":"circular-informativa-huelga-general-8-de-marzo","status":"publish","type":"post","link":"https:\/\/serhsserveis.com\/es\/circular-informativa-huelga-general-8-de-marzo\/","title":{"rendered":"Circular Informativa Huelga General 8 de marzo"},"content":{"rendered":"<h3>El sindicato Intersindical-CSC ha convocat una vaga general en Catalunya para el pr\u00f3ximo d\u00eda 08.03.2020, en la franja horaia de 0:00 a 24:00 y en todo el \u00e1mbito territorial de Catalu\u00f1a.<\/h3>\n<p>Los sindicatos m\u00e1s representativos (CCOO y UGT) no se han adherido formalmente a la convocatoria de huelga.<\/p>\n<p>Mediante la presente circular les recordamos los principales aspectos que tienen que tener en consideraci\u00f3n relacionados con la huelga en cuanto a derechos y obligaciones; tanto del empresario como del trabajador.<\/p>\n<p>Las principales consecuencias del ejercicio del derecho a la huelga son las siguientes:<\/p>\n<ul>\n<li>No extingue el contrato laboral, solo se limita a suspenderlo durante la duraci\u00f3n de la huelga.<\/li>\n<li>Exonera al trabajador de su obligaci\u00f3n de trabajar y al empresario de su obligaci\u00f3n de abonar el salario correspondiente al d\u00eda concreto de la convocatoria.<\/li>\n<li>El descuento que se ha de aplicar sobre la retribuci\u00f3n del trabajador que usa el derecho a la huelga se aplica sobre su salario base + complementos salariales. (salario d\u00eda) y sobre la parte proporcional de las pagas extras. Pero no afecta a las vacaciones.<\/li>\n<li>El derecho a la huelga es individual y voluntario. Por lo tanto, la empresa tiene que respetar la voluntad tanto del trabajador que se suma a la convocatoria como el que decide ir a trabajar. No se puede cerrar el centro de trabajo ni sancionar al trabajador que no asiste a trabajar.<\/li>\n<li>Ahora bien, si la empresa opta por el cierre del centro de trabajo porque quiere adherirse a la protesta, o por cualquier otro motivo, no podr\u00e1 aplicar ning\u00fan tipo de descuento salarial ni repercusi\u00f3n a nivel de seguridad social.<\/li>\n<li>Mientras dura la huelga no existe la obligaci\u00f3n de cotizar por parte del empresario ni del trabajador. Por lo tanto, el trabajador es dado de baja durante el periodo de duraci\u00f3n de la huelga. Una vez acaba la huelga se vuelve a la situaci\u00f3n ordinaria de alta.<\/li>\n<li>Existe la prohibici\u00f3n expresa de contratar trabajadores para sustituir a los trabajadores huelguistas, aunque sea a trav\u00e9s de E.T.T.<\/li>\n<li>El trabajador no est\u00e1 obligado a avisar de que se acoge al derecho de huelga.<\/li>\n<\/ul>\n<p><strong>Es importante que se comunique al departamento de Administraci\u00f3n de Personal, como m\u00e1ximo el d\u00eda 09.03.2020, la relaci\u00f3n de trabajadores que han ejercido este derecho para que se\u00a0 comunique\u00a0 a la Tesorer\u00eda General de la Seguridad Social en plazo el movimiento de alta y baja posterior.<\/strong><\/p>\n<h5 style=\"text-align: center;\">Estamos a tu disposici\u00f3n para cualquier aclaraci\u00f3n al respecto.<\/h5>\n","protected":false},"excerpt":{"rendered":"<p>El sindicato Intersindical-CSC ha convocat una vaga general en Catalunya para el pr\u00f3ximo d\u00eda 08.03.2020, en la franja horaia de 0:00 a 24:00 y en todo el \u00e1mbito territorial de Catalu\u00f1a.
