{"id":28867,"date":"2023-01-23T07:26:34","date_gmt":"2023-01-23T06:26:34","guid":{"rendered":"https:\/\/serhsserveis.com\/?p=28867"},"modified":"2023-01-23T13:44:04","modified_gmt":"2023-01-23T12:44:04","slug":"tu-empresa-dispone-del-registro-retributivo-del-ejercicio-2022","status":"publish","type":"post","link":"https:\/\/serhsserveis.com\/es\/tu-empresa-dispone-del-registro-retributivo-del-ejercicio-2022\/","title":{"rendered":"\u00bfTu empresa dispone del registro retributivo del ejercicio 2022?"},"content":{"rendered":"<h3>El <a href=\"https:\/\/www.boe.es\/buscar\/pdf\/2019\/BOE-A-2019-3244-consolidado.pdf\" target=\"_blank\" rel=\"noopener\">Real Decreto Ley 6\/2019<\/a> obliga a que todas las empresas con personas trabajadoras por cuenta ajena dispongan de un registro retributivo de toda la plantilla.<\/h3>\n<p>Con el objetivo de <strong>garantizar la igualdad de trato y oportunidades entre mujeres y hombres en el empleo<\/strong> se indica que todas las empresas deben disponer, para asegurar una transparencia retributiva, el registro retributivo con periodicidad anual. De hecho, en el art\u00edculo 28, se dispone el detalle de \u00abla igualdad de remuneraci\u00f3n por raz\u00f3n de sexo\u00bb.<\/p>\n<p>A esta obligaci\u00f3n de transparencia retributiva se le suma el Real Decreto 902\/2020, de 13 de octubre, de igualdad retributiva entre mujeres y hombres, donde se establecen las medidas espec\u00edficas para hacer efectivo el derecho a la igualdad de trato y la no discriminaci\u00f3n entre mujeres y hombres en materia retributiva.<\/p>\n<h3>\u00bfC\u00f3mo tienen que ser este registro retributivo?<\/h3>\n<ul>\n<li>Es <strong>obligatorio<\/strong> para todas las empresas y de car\u00e1cter <strong>anual<\/strong>.<\/li>\n<li>Debe incluir toda la informaci\u00f3n sobre las <strong>retribuciones de la plantilla<\/strong>, incluyendo el personal directivo y altos cargos.<\/li>\n<li>Recoge los valores la de media aritm\u00e9tica y la mediana <strong>desagregados por sexo y distribuidos por grupos profesionales, categor\u00edas profesionales o puestos de trabajo<\/strong> iguales o de igual valor de:\n<ul>\n<li>Salario base.<\/li>\n<li>Complementos salariales.<\/li>\n<li>Percepciones extrasalariales.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3>\u00bfEs obligatorio llevar este registro?<\/h3>\n<p>S\u00ed, ya que su incumplimiento (definido por la Ley de Infracciones y Sanciones en el orden Social) recoge como <strong>infracci\u00f3n grave<\/strong> \u201cno cumplir con las obligaciones que en materia de planes de igualdad y medidas de igualdad que establece la Ley Org\u00e1nica 3\/2007, del Estatuto de los Trabajadores, o el convenio colectivo de aplicaci\u00f3n\u201d.<\/p>\n<p>De hecho, este a\u00f1o se prev\u00e9 que se intensifiquen a\u00fan m\u00e1s las inspecciones relacionadas con los Planes de Igualdad en las empresas por parte de Inspecci\u00f3n de Trabajo de Catalu\u00f1a (ITC) de la consejer\u00eda de Empresa y Trabajo de la Generalitat. Esto ha supuesto que se hayan propuesto <a href=\"https:\/\/serhsserveis.com\/es\/se-incrementan-las-multas-e-inspecciones-con-motivo-del-plan-de-igualdad\/\">sanciones importantes que incumplan prop\u00f3sitos como la discriminaci\u00f3n salarial por motivo de g\u00e9nero, acoso sexual o carencia de los propios planes de igualdad<\/a>, entre otros.<\/p>\n<blockquote><p><em><strong>Las sanciones por no tener al d\u00eda el registro retributivo pueden comportar multas de 626\u20ac a 6.250\u20ac<\/strong><\/em><\/p><\/blockquote>\n<p>Recuerda que todas las empresas, con independencia del n\u00famero de empleados que tengan, est\u00e1n obligadas a realizar el registro retributivo, incluidos altos cargos y personal directivo.<\/p>\n<p>Por otra parte, las empresas de m\u00e1s de 50 trabajadores tienen la obligaci\u00f3n de tener elaborado e implantado un <a href=\"https:\/\/serhsserveis.com\/es\/plan-igualdad-para-empresas\/\"><strong>Plan de Igualdad<\/strong><\/a> y realizar una auditor\u00eda retributiva que contenga un informe diagn\u00f3stico y un plan de actuaci\u00f3n para la correcci\u00f3n de desigualdades.
