Circular Informativa"},"content":{"rendered":"<h3>Desde el Departamento de Servicios Jur\u00eddico-laborales te lo contamos todo<\/h3>\n<p><span style=\"font-weight: 400;\">El d\u00eda <\/span><b>08 de marzo<\/b><span style=\"font-weight: 400;\"> se celebra el D\u00eda Internacional de la Mujer y los sindicatos han convocado una Huelga General.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Algunos sindicatos han convocado una huelga de <\/span><b>24 horas de duraci\u00f3n<\/b><span style=\"font-weight: 400;\"> (CNT) y otros (CCOO y UGT) una huelga de <\/span><b>dos horas de duraci\u00f3n por turno de trabajo <\/b><span style=\"font-weight: 400;\">( \u00abparadas\u00bb): entre las 11:30 h. y las 13:30 y las 16:00 h. y las 18:30 h.\u00a0<\/span>Las principales consecuencias del ejercicio del derecho a la huelga son las siguientes:<\/p>\n<p><span style=\"color: #66008c;\"><b>TRABAJADORES HUELGUISTAS<\/b><\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">El derecho a la huelga es individual y voluntario.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> No se puede sancionar al trabajador que no asista al trabajo.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">El trabajador no est\u00e1 obligado a preavisar a la empresa su intenci\u00f3n de hacer huelga.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #66008c;\"><b>TRABAJADORES NO HUELGUISTAS<\/b><\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">El derecho fundamental a la huelga tambi\u00e9n garantiza el derecho de los trabajadores a no adherirse y ir a trabajar.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #66008c;\"><b>CONSECUENCIAS DE LA HUELGA EN LA RELACI\u00d3N LABORAL<\/b><\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">No extingue el contrato laboral, s\u00f3lo se limita a suspenderlo mientras dura de la huelga.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Exonera al trabajador de su obligaci\u00f3n de trabajar ial&#8217;empresari de su obligaci\u00f3n de abonar el salario correspondiente al d\u00eda concreto de la convocatoria.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> Descuento del d\u00eda no trabajado por huelga:<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">El descuento que se ha de aplicar sobre la retribuci\u00f3n del trabajador que utiliza el derecho a huelga se computa sobre su salario base + complementos salariales y sobre la parte proporcional de las pagas extras. Pero no afecta a las vacaciones.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En el caso de esta huelga, la empresa deber\u00e1 comprobar si el trabajador ha faltado toda la jornada, conforme a la convocatoria de huelga de 24 horas o bien s\u00f3lo las 2 horas de las \u00abparadas parciales\u00bb<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Si la empresa opta por cierre del centro de trabajo porque quiere adherirse a la protesta, o por cualquier otro motivo, no podr\u00e1 aplicar ning\u00fan tipo de descuento salarial ni repercusi\u00f3n a nivel de seguridad social<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Existe la prohibici\u00f3n expresa de contratar trabajadores para sustituir a los trabajadores huelguistas, aunque sea a trav\u00e9s d&#8217;ETT<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #66008c;\"><b>SEGURIDAD SOCIAL<\/b><\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Los trabajadores en huelga se mantienen en situaci\u00f3n de alta especial en la Seguridad Social, con suspensi\u00f3n de la obligaci\u00f3n de cotizar por parte del empresario y del trabajador.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> Las empresas deben comunicar a la Administraci\u00f3n de la Tesorer\u00eda General de la Seguridad Social la relaci\u00f3n de trabajadores con contrato suspendido como consecuencia de la huelga, en un plazo m\u00e1ximo de 5 d\u00edas naturales.<\/span><\/li>\n<\/ul>\n<p><i><span style=\"font-weight: 400;\">Es importante que comunique al departamento de Administraci\u00f3n de personal, <\/span><\/i><b><i>como m\u00e1ximo el d\u00eda<\/i><\/b><i><span style=\"font-weight: 400;\">03\/12\/2018,la relaci\u00f3n de trabajadores que han disfrutado de este derecho y en qu\u00e9 extensi\u00f3n lo han hecho, para que se comunique a la Tesorer\u00eda General de la Seguridad Social en plazo el movimiento correspondiente.<\/span><\/i><\/p>\n<p><span style=\"color: #66008c;\"><b>SERVICIOS M\u00cdNIMOS<\/b><\/span><\/p>\n<p><span style=\"font-weight: 400;\">Est\u00e1n regulados Orden TSF \/ 2018, de 01 de marzo, por la que se garantizan los servicios esenciales que se deben prestar en Catalu\u00f1a.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><strong>Para cualquier duda o aclaraci\u00f3n contacta con nuestro Departamento de Servicios Jur\u00eddico-laborales a <a href=\"mailto:eva.cedo@serhs.com\">eva.cedo@serhs.com<\/a> o <a href=\"mailto:toni.montoliu@serhs.com\">toni.montoliu@serhs.com<\/a>.
